On the 7th day of December 2023, the Federal High Court, Benin Judicial Division, granted Leave to the Registered Trustees of One Love Family Caring [Aka One Love Foundation] and Chief Patrick Osagie Eholor to apply for an Order of Injunction by way of Judicial Review against the Inspector General Of Police; the Independent National Electoral Commission; and the Attorney General of the Federation.
The Relief being sought by the Applicants in the Suit is for An Order To Show Cause to be issued upon the Inspector General of Police, the INEC as well as the Attorney General of the Federation to show by what authority under the provisions of Sections 9, 83 & 136 of the Nigeria Police Act, 20202 or Sections 2 & 126 of the Electoral Act, 2022 the aforesaid Respondents claims to be entitled to order the restriction of any form of free movement by citizens of Nigeria across all States of the Federation and the FCT during any General Elections in Nigeria (as was done on during the course of the 2023 General Elections held on the 25th of February 2023 and 11th March 2023) in a manner inconsistent with Section 41 of the Constitution of the Federal Republic of Nigeria.
The Suit also seeks an Injunction to restrain the Inspector General of Police, the INEC as well as the Attorney General of the Federation from forthwith acting in the office or powers created by Sections 9, 83 & 136 of the Nigeria Police Act, 20202 or Sections 2 & 126 of the Electoral Act, 2022 in which they are not entitled to act or exercise in a manner inconsistent with Section 41 of the Constitution of the Federal Republic of Nigeria – to wit, order the restriction of any form of free movement by citizens of Nigeria across all States of the Federation and the FCT during any General Elections in Nigeria (as was done on during the course of the 2023 General Elections held on the 25th of February 2023 and 11th March 2023).
