The Trustees of One Love Caring Foundation popularly known as One Love Foundation and Trustees of Initiative for Rural Development, Information and Legal Advocacy (RUDILAC) have joined hands together to call on the court to sack the new chairman of Economic Financial Crimes Commission (EFCC) Mr. Ola Olukayode who was confirmed by Senate of the National Assembly on Friday 20th day of October 2023.
According to Wikipedia.org The Economic and Financial Crimes Commission (EFCC) as "a Nigerian law enforcement agency that investigates financial crimes such as advance fee fraud (419 fraud) and money laundering.[1] The EFCC was established in 2003, partially in response to pressure from the Financial Action Task Force on Money Laundering (FATF), which named Nigeria as one of 23 countries non-cooperative in the international community's efforts to fight money laundering. The agency has its head office in Abuja, Nigeria."
The reliefs sought against the new EFCC chairman include a declaration that the appointment of Olukayode as the Chairman of EFCC in in breach of Section 2 (1) (A) (i), (ii), (iii) of the Economic Financial Crimes Commission Act 2004 and also calling on the court to declare that that he is not qualified to be so appointed.
It was stated that Mr. Olukayode was not a routine Commission staff but an appointee. They added that the Chairman of the Commission must be a serving or retired member of the Commission not below the rank of Assistant Commissioner of Police or equivalent and must possess not less than 15 years cognate experience.
The summon was taken out by Osazuwa Osazogie, Esq of FOI Counsel. According to her “The Commission is a paramilitary organization, which is the rationale behind the inclusion of the police ranking system to demonstrate the minimal level of combatant operation required as a prerequisite for attaining the position of the Executive Chairman of the Commission”
Therefore, tomorrow Thursday 30th of November, 2023 has been scheduled for the case at the Federal High Court, Sapele Road, Benin City, Edo State.
